Mediation on every Shore

With the limited access to courts and lawyers mediation is even more so now than ever the best choice to find a resolution for your dispute. Get your dispute resolved now while you can’t go anywhere you can really concentrate on what’s important and what deserves your time and energy.

Northwest Mediation uses Zoom, Skype and FaceTime as well as the phone and emails to resolve disputes so please do not feel that you cannot contact us as there are limits on physical meetings.

NPC (who are in a reorganisation bankruptcy under Chapter 11 in the states which is akin to an administration in the UK) are trying to sell their 900 Pizza Hut franchises along with over 300 Wendy’s.

The Flynn Restaurant group had made a bid but NPC had refused on the basis that Flynn owns Taco Bell and Arby's which are in direct competition with many of the franchise locations, and with a debt of over $900 million NPC are keen to get the bets deal for the locations in order to pay off their creditors.

The judge handling the case has now ordered the parties to attend mediation to try and reach a resolution. There is a pun here somewhere about slicing up the pizza pie but I just can't find it today.

Mediation will allow the parties to confidentially explore their concerns about the effect of the bid and the amount offered and work towards a resolution if one is possible, it’s unknown if any other bidders are likely to come forward in the current climate where restaurants are suffering due to Covid restrictions.

We previously commented on the mediation offers for the war in Ethiopia now the Sudanese PM Abdalla Hamdock has arrived and offered to help s mediator.

He faces stiff opposition to his efforts as the Ethiopian official position is that there is a ceasefire in place so no further input is required to bring peace to the region, momentary peace of course is rather different to stability.

Abiy Ahmed, Ethiopian PM said that the talks had helped cement relations with Sudan but in respect of mediating between opposing sides in the conflict his spokesperson said “Mediate what? The military altercation has ceased with the command of Mekelle ... The provisional administration has set up and a regional council formed in Tigray…Remnants of the criminal clique have fled”

As ever it is difficult to mediate if one party is unwilling to acknowledge there is an issue.

Jersey Shore (as I understand it) was one of those god awful not actually reality TV shows which like TOWIE over here made minor celebrities out of individuals happy to cause strife and over react to camera.

Now one of the people who appeared on Jersey Shore has declared his intent to act as a mediator following the Jersey Shore “family” fallout after Angelina Pivarnick’s wedding (honestly, as I write this stuff I think who? What? Why? There’s actually quality, meaningful programmes out there, no one should want or need to watch this rubbish, it’s not even bubblegum for the brain it’s more like raw cane sugar rotting you from the inside and making you think over-reaction and melodrama is normal behaviour).

Anyway digression aside Mike Sorrentino, previously known as "the Situation", has declared himself "the Mediation” (his grasp of grammar clearly leaves a lot to be desired) as an impartial player he intends to find a way to heal the Jersey Shore family rifts, no doubt on camera with as much drama as possible – just about as far from actual mediation as it’s possible to get.

Don’t you love this week’s juxtaposition? From Jersey Shore to the West Bank.

European Director of Morocco’s press agency MAP Adil Zaari said this week of Morocco’s involvement in the middle east peace process

‘’Morocco is known for its historic mediation in the Israeli-Palestinian conflict. King Mohammed VI is chairman of a committee called Al Quds (Jerusalem) which works for Palestinian rights and he has excellent relations with both Israelis and Palestinians. So if today the entire international community is working for the rapprochement of the Israelis and the Palestinians for a peace solution, Morocco presents itself as an additional support to all these efforts” Morocco has historic form for acting as mediator between the two nations back in 1995 Shimon Peres, the then Israeli foreign minister, and Palestinian President Yasser Arafat were hosted in Moroccan capital Rabat working towards the peace process.

Mohammed Ameur Morocco’s ambassador to Belgium added ‘’Morocco intends to take advantage of its diplomatic relations with Israel, the exceptional links with Moroccan Jews, who are more than a million, the esteem enjoyed by the Moroccan monarchy to promote peace in the region and encourage negotiations between Israel and the Palestinians on the basis of the two-state solution’’

It’s good for a mediator to have examples of previous mediation work and although historical examples of mediation aren’t easy for new mediators and we’re fortunate that Northwest Mediation and the mediators we work with have been around long enough to have proven track records.

As we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor so you can get out the tunnel and see the light. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.

By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.

The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.

There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public will go to avoid referral.
