Staying in the states a judge in Indiana’s Howard County is going to mediation. Howard county council have ordered the judge (Judge Menges) to give his staff a pay rise, but the judge has thus far refused, hence the intervention of mediation.
Now you know when the judiciary start utilising mediation that there have to be good reasons, there are – it’s quicker, cheaper, less stressful and more likely to resolve the issues than court. Granted this has taken n order of Indiana’s supreme court to get the judge to go to mediation but even that order recognises that mediation should be attempted first and foremost rather than court proceedings.
Still in the US the decision last July by DeSoto County to decline Mosaic Mining company’s request to mine for phosphate around Arcadia Florida by declining to “re-zone” part of the county has understandably led to the mining company seeking legal redress.
Under the Florida Land Use and Environmental Dispute Resolution Act it is open to parties to take any dispute to mediation and this is the avenue which the mining company have opted to follow.
Remaining on the other side of the pond claims for injuries and death arising from exposure to asbestos may now be heading to mediation, unfortunately due to GDPR I can’t read the detail of the press releases so I can only speculate that the quango Assembly in Maryland’s decision to direct thousands of asbestos claims to mediation is a further acknowledgement of the need for claims of all types to go first to mediation.
This is particularly so where there are more than just damages at issue. With its wide scope of potential resolutions including apologies, help with health care, changes in practice and procedure mediation.
We can't escape US stories of mediation this week! Mediators have been called in to the ongoing disputes with Stop & Shop and its employees represented by the United Food and Commercial Workers Union.
President of United Food and Commercial Workers in Springfield Daniel P. Clifford said the mediators will be “Commissioners with the Federal Mediation and Conciliation Service, a Federal agency out of Boston, whose role is to assist both labour and management whenever the collective bargaining process is at a critical stage”
For the Ahold Group which owns Stop & Shop Philip Tracey (the least famous of the Thunderbird’s) said "Stop & Shop is ready and available to continue negotiating in good faith with the five UFCW locals to reach a new contract that continues to offer strong wages and benefits for our Associates and that keeps the Divisions competitive in the New England market."
Well it’s a short Mediation Blog this week but it’s nearly Easter and with the holidays (and the start of the Church’s year) coming maybe now is as good a time as any to step back from your personal or business dispute and consider if spending hours worrying, thousands on representation and months waiting for the outcome of legal proceedings is really worth it, when there is a viable alternative in the form of mediation.
You lose nothing by asking “what is mediation?” or “is mediation for me?” “how can mediation help my business?”
There are so many cases which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public (and some lawyers) will go to avoid referral.
