This article by Chris Robinson at HGF Intellectual Property Experts agrees with my comment above that lockdown is not a reason to avoid mediation and is as effective certainly when running a caucus or shuttle style.
Meanwhile in the National Students Union of India has appealed to central government to intervene and mediate between the NSUI and exam boards of Class X and Class XII who have scheduled exams to proceed despite the current pandemic.
Ahraz Mulla NSUI State President said in his letter to the government “The decision of having exams of SSC students from May 21, 2020 during a pandemic after the recent information of 15 COVID-19 cases within a span of four days has been widely criticised by the students and people of Goa. After requesting the Chief Minister for an urgent appointment and requesting him with the help of media to postpone exams there has been ‘no positive’ response from your kind authority and we are forced to launch a State-wide movement ‘Exams Postpone Karo Na’, an initiative to save Goa from coronavirus.”
One alternative the students are threatening to the mediation is to go on hunger strike, which is evidence of the strength of feeling. Speaking as someone whose eldest has had all his GCSEs cancelled I have a small level of understanding of the feelings involved in wanting to have the exams conflicting with the need to protect lives. In my humble opinion, exams can be re-scheduled or resat lives cannot.
In other university news mediation Carole Katz mediator extraordinaire conducted a mediation earlier this month and the case settled immediately afterwards.
Estelle Belko had lodged a claim against "Pitt" University alleging her dismissal was based on her disability under the Americans with Disabilities Act and the Pennsylvania Human Relations Act.
Belko had disclosed her epilepsy on interview and prior to being employed by the university but argued she had been dismissed as a result of her condition.
A settlement was achieved although no details have been released (as should be the case in confidential mediation) nor has it been confirmed if she has been given her job back. Reinstatement is one of the primary awards an employment tribunal can make but often by the time of a tribunal either the employee has moved on or the bitterness is such that there can be no reasonable re-employment, it’s just another good reason to mediate early.
OK it’s not a mediation story per se but I do like the idea that actors can become mediators between the masses and the medical experts. Indian actress Shwetha R Prasad accepts that during the pandemic there is a role for celebrities on social media to help and not to conflate problems and panic.
If you could choose an actor to spread sense and calm would it be James McAvoy (as Professor X rather than any of his Split characters), Richard E Grant (whose daily Withnail and Isolation have been highly entertaining if not quite family viewing) or perhaps Samuel L Jackson (as Mace Windu not Jules Winnfield).
Don’t hesitate to contact Northwest Mediation with your details using the chat button, filling in the contact form, phoning us or email, we can get back to you quickly and get the ball rolling often for free.
As we’ve said before choose to mediate early and resolve your issues effectively, quickly but with sufficient and sensible pauses for reflection, and with less stress and costs than going to your solicitor. You have an interest in the outcome the sooner you get around the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.
By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.
The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.
There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public (and some lawyers) will go to avoid referral.
