Mediation news brief


With the limited access to courts and lawyers mediation is even more so now than ever the best choice to find a resolution for your dispute. Get your dispute resolved now while you can’t go anywhere you can really concentrate on what’s important and what deserves your time and energy.

Northwest Mediation uses Zoom, Skype and FaceTime as well as the phone and emails to resolve disputes so please do not feel that you cannot contact us as there are limits on physical meetings.

We don’t see too many personal injury mediations (despite it being the area of law in which I cut my teeth many years ago) but clearly it can happen and here (focusing on a 10 year old as lead plaintiff as they still call claimants in the US) a group of claims were settled for a somewhat eye watering sum via mediation.


No doubt the lawyers were on a cut of the damages but nonetheless it’s a good result for the claimants reducing time, stress and cost through mediation.



Mayor Nick Gradisar has said that talks in mediation over the statue of Christopher Columbus (not pictured) have been productive and that further discussions will continue to find a resolution for all parties.


“I did get a report Saturday after those meetings, I haven’t heard about Sunday’s meetings, and the mediator thought they had gone well I think in terms of people showing up with open minds and talking in good faith…I think that it’s a start...I think that’s a positive that people are at the table talking about identifying what the issues and interests are and how those can all be addressed.”


Mediator Fred Galves is helping the parties and talks resume a the end of this week, parties include those wholly opposed to the removal of the historic figure and those in favour of it being removed due to Columbus’ actions.


The statue is on the Mesa Junction across from the Robert Hoag Rawlings Public Library in Pueblo City, Colorado.


Don’t be fooled by the headline in this article, there’s little if any evidence of the Commander of Cheese having lent a hand in the mediation which resolved the Bath shipyard strike between Bath Iron Works and the Local S6 union. Federal Mediation and Conciliation Service who conducted the mediation listed the following as having contributed to the successful outcome:-


“Assistant to the President and Director of the Office of Trade and Manufacturing Policy Peter Navarro, AFL-CIO Metal Trades Department President Jimmy Hart and IAM International President Robert Martinez,” not the thin skinned orange in charge, but then when did the truth ever matter to 45.


Meanwhile nearly 90 properties in Archdiocese of Agana, Guam, are going to be used to fund the damages to be paid to abuse survivors.


A case conference scheduled for last Friday has been vacated as the parties were able to confirm progress was being made through mediation.



The archdiocese had originally suggested using $21million of its funds in bankruptcy to pay survivors but those representing the survivor groups had argued against the method and amount of payout.


In a joint statement the parties confirmed they "have made considerable progress in communicating and reconciling their respective positions on the availability of certain real property assets to fund a potential settlement and joint plan of reorganization in this case"


The mediator appointed by the court is US Bankruptcy Judge Robert Faris.


In F1 news (and it’s not often I get to mention the only sport I enjoy) Toto Wolff is acting as mediator to try and prevent BWT Racing Point’s team being given a penalty for their design of the rear braking system. The design is said to have been a copy of Mercedes’ system and therefore a breach of copyright and more importantly the 2020 rules but will be allowed to continue using the system subject to penalty.


The other teams are pressing for harsher penalties but Toto is trying to find a way forward.

As we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.


By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.


The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.
