Well some progress on the old accreditation front, provisional which means that 10 years of experience isn’t quite enough to convince the powers that be to give me an immediate full access all areas pass! More courses and more cases, which would be what happened anyway, so the work continues.
In the meantime mediation continues to grow in use and popularity.
I do love a landlord/tenant mediation. They’re so useful when the relationship needs to continue with as little damage to the interplay between parties as possible.
70 years ago the SS United States set the record for crossing the Atlantic, it’s now moored in the Delaware river and the group in charge of its preservation is in dispute with Penn Warehousing, the landlord (or land lubber lord).
Penn has been accused of interfering with efforts to sell the ship (or is it boat I can never remember sorry Captain Pugwash fans) no time table yet for the mediation but the appointment of a federal judge suggests it will be more akin to arbitration than mediation but still at least it is a sensible approach to resolving a dispute for an historic vessel.
I don’t talk too much about the mediation efforts in the two wars which feature most in the news in the UK, that is the wars in Ukraine and Palestine, partly because this is a light blog about mediation and not an examination of rights and wrongs (which is frankly not what mediation is about anyway) but occasionally there’s some glimmer of good news out of one or other of those conflicts so I mention Ukraine today.
According to Gulf Today the UAE’s mediation efforts have seem another release of POWs back to Russia, you do wonder given Vlad has never accepted it was a war how he justifies referring to the prisoners taken in the invasion by Russia as POWs. But the war never made much sense (other than nit being a grain grab) I don’t suppose it will start doing so anytime soon.
Not in anyway a lighter note but to reflect the breadth of applicability of mediation we also have Cher this week withdrawing her attempt to gain control by conservatorship over her son’s finances.
It’s been an ongoing battle for Cher and he son Elijah, following concerns over his mental health and drug use Cher attempted to be appointed conservator (akin to guardian this side of the pond).
Elijah is due to inherit from his late father and Cher was concerned that all that cash might lead him back into drug abuse, throughout the case Elijah has been very clear that he does not require the help being offered by his mother.
It’s hard even when you’re a megastar to let go of your kids I guess, via mediation they have been able to agree to the attempted conservatorship being withdrawn but without any bar on future applications should Cher become concerned again.
The three pillars of mediation remain it’s voluntary (at the moment), it’s confidential, the mediator is impartial and independent, by using those pillars to support your work the parties keep control, save costs, save time and energy and reduce stress.
In person or via electronic media as we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor so you can get out choose a different path, not quite the road less travelled but perhaps the path less adversarial. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.
By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.
The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever-changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.
There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public will go to avoid referral.
