What Mediation isn't

With the limited access to courts and lawyers mediation is even more so now than ever the best choice to find a resolution for your dispute. Get your dispute resolved now while you can’t go anywhere you can really concentrate on what’s important and what deserves your time and energy.


Northwest Mediation continues to use Zoom, Skype and FaceTime as well as the phone and emails to resolve disputes so please do not feel that you cannot contact us as there are limits on physical meetings.



It’s holiday and camping week this week so apologies for the short blog


I spend a lot of time explaining to people on holiday what mediation is and I’m always reminded of John Hegley’s “What a Poem’s Not” and so with that in mind:-


Mediation isn’t an aardvark though it can be hard to get into,

Mediation isn’t a battle though parties often are battling

Mediation isn’t a cream tea, but it can be fulfilling

Mediation isn’t deafening, though somethings are hard to hear

Mediation isn’t for everyone, but it probably is

Mediation isn’t a fight, though it can be tough

Mediation isn’t a growth, but you will grow through it

Mediation isn’t a hobby, though it can free you up to spend more time enjoying each of your wonderful hobbies,

Mediation isn’t invisible, though some of the benefits are hard to see before you begin

Mediation isn’t just ticking a box, but it can leave both sides feeling justified

Mediation isn’t kicking down doors, but it may be taking down barriers

Mediation isn’t light, it’s heavy and illuminating...so maybe it is light

Mediation isn’t magic, though the results are often magical

Nor is it meditation, no matter what autotext says though it can bring a sense of calm

Mediation isn’t noting down everything said and done but it is noting what feelings infrom and lead to actions

Mediation isn’t oration, though there’s a lot to say

Mediation isn’t the pickle in a cheese and pickle sandwich, though it get you out of a pickle

Mediation isn’t a quarrel, though a well placed question can hit like a bolt

Mediation isn’t revolution, though the results could be revelatory

Mediators aren’t sneaky, though some of us wear sneakers

Mediation isn’t a trick, though it can be tricky

Mediation isn’t uniform, though each one has elements of similarity with another no one mediation is the same as any other, we’re all individuals, even you

Mediation isn’t viral, though it is catching on

Mediation isn’t win-lose it’s win win

Mediation isn’t an x-ray though it looks beyond the surface

Mediation isn’t yachting but you may need to take different tacks to find calmer waters

Mediation isn’t a zebra, nothing is ever black and white


In person or via electronic media as we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor so you can get out choose a different path, not quite the road less travelled but perhaps the path less adversarial. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.


By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.


The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever-changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.


There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public will go to avoid referral.
