No real linking idea this week as it’s been a difficult week in practice, certain blocks to movement forward which seem at the moment immovable, but perhaps I just need to take my own advice, take a beat treat every set back as an opportunity and reengage after reinvigorating on the upcoming holiday.
I’d like to share more but it would end with me explaining quite how closed a shop and what a clear money spinner for those already up the levels in mediation can feel (sometimes feels more like an L Ron Hubbard cult than a profession). I am getting to the point where either I’ll be lodging complaints/appeals or asking for a mediator!
Following Atatiani Johnson’s shooting by police in Fort Worth USA Jamaal Johnson experienced years of frustration trying to reach a resolution with the police at one stage asking how black people were supposed to feel safe in their own homes?
Now following training over 6 days and 45 hours he and eleven other residents are engaging with others and the police to assist in conflict between the two groups.

Now residents who have filed a complaint with the police can begin mediation utilising the services of one of the trained mediators to work between the citizen and the officers.
Training as you would expect involved ensuring the mediator could remain neutral and not inflame the situation (I particularly like the role play description where the conflict arose from the sounding the car horn at a police office writing a ticket and blocking the resident’s way).
Sticking with coppers and mediation, in the US criminal mediation is still possible and here Mark Brave former Strafford County Sheriff is accused of 80 felony charges including theft.
He’s failed to agree a plea bargain and so, in something I find hard to get my head round, he’s going to try mediation.
In this case the mediator is the judge, which in the UK wouldn’t be mediation, it wouldn’t even be arbitration if it’s the same judge as is hearing the criminal case, so I’m not sure what we call it, I suppose ADR comes in many flavours.
I don’t like advertising for others but National Family Mediation is a charity so I’ll make an exception, they have ahead of the easter holidays (some of which have already started lucky people) launched a guide to tackling difficult topics – as matters often reach a head during and after school holidays.
Christmas easter and summer holidays are the flash points for far too many clients and part of our mediation practice is to discuss those matters before they become an issue.
The three pillars of mediation remain it’s voluntary (at the moment), it’s confidential, the mediator is independent, by using those pillars to support your work the parties keep control, save costs, save time and energy and reduce stress.
In person or via electronic media as we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor so you can get out choose a different path, not quite the road less travelled but perhaps the path less adversarial. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.
By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.
The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever-changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.
There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public will go to avoid referral.
